AWOL Army medic charged with desertion PDF Print E-mail

A medic who went absent without leave in September to avoid a second tour in Iraq has been formally charged with desertion and missing movement, according to a U.S. Army spokesman.

If convicted of both offenses, Spc. Agustin Aguayo, with the 1st Battalion, 18th Infantry Regiment, could receive a maximum prison term of seven years, said Maj. Eric Bloom, spokesman for the Joint Multinational Training Command in Grafenwöhr, Germany. He also faces the forfeiture of all pay and allowances, demotion to the lowest enlisted rank and a dishonorable discharge.

War Objector Fate May Rely on Old Cases PDF Print E-mail

WASHINGTON -- A federal appeals court is rereading cases from the Vietnam era as it considers whether to allow an honorable discharge for an Army medic who announced his objections to war on the eve of his deployment to Iraq.

Appeals courts heard several cases on "conscientious objectors" during the Vietnam War draft but such appeals are much more rare in an all-volunteer military.
Agustin Aguayo, who enlisted in 2002 during the lead-up to the Iraq war, is asking the U.S. Court of Appeals for the District of Columbia to release him from a military prison. It is believed to be the first federal appeal in a conscientious objector case during the Iraq war.

WASHINGTON — Lawyers for Spc. Agustin Aguayo on Tuesday asked a federal appeals panel to overturn both the Army’s decision to deny the medic conscientious objector status and a court ruling earlier this year backing the Army’s finding.

Attorney Peter Goldberger said the Army failed to present a clear argument why his client — a 1st Battalion, 18th Infantry Regiment soldier — didn’t qualify for a discharge from the service on a basis of his beliefs, and that it must be held accountable by the civilian courts.

Army Specialist Agustin Aguayo -- a Mexican-born, naturalized U.S. citizen from Los Angeles and a veteran of the Iraq War -- is in a U.S. military prison in Germany awaiting court martial and a possible jail sentence of up to seven years for refusing a second deployment to Iraq.  Meanwhile, the United States Court of Appeals for the District of Columbia Circuit is considering Aguayo’s appeal of the Army’s refusal to release him from the military on the grounds that he is a conscientious objector; the Court will hear oral argument about his case on November 21.  If Aguayo prevails in his appeal, the Army will be required to recognize his sincere conscientious objection and discharge him.
